Home Depot Tool Rental Agreement

This call is about a question that many consumers regularly face – should I buy the extra protection offered by that purchase or rent?   John Rickher has asked himself the question in recent years on more than a dozen occasions by renting tools and equipment from Home Depot stores in Chicago.   On every occasion, Rickher entered into a tripartite contract – the lease – with The Home Depot.   The first page is a copy of the Home Depot agreement.   It describes the description and price of the rent with broken down fees;  One line is called “Damage Waiver”.   The first page also contains a “Special Conditions” section, which contains the following statement: “I accept the benefits of the declaration of non-damages (if any) described in paragraph 11 in the general terms and conditions of the rental agreement.”   The customer signs the first page of the contract under this declaration of acceptance. . . .
